By using our mobile application, Hummingbird (the "App"), you agree to be bound by these Terms and Conditions. If you do not agree, do not use the App. These terms govern your access to and use of our App and any services offered through it.

The Hummingbird app provides wellness, fitness, and nutritional information designed for educational purposes only. This information is not a substitute for, and does not replace, professional medical advice, diagnosis, or treatment. To use the App, you must register for an account. You agree to provide accurate, current, and complete information during the registration process. You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
You agree not to use the App for any unlawful purpose or to engage in any activity that would violate the rights of others. You are solely responsible for your interactions with other users and for any content you post.
The App and its original content, features, and functionality are and will remain the exclusive property of Hummingbird Wellness, LLC and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
We may terminate or suspend your account and bar access to the App immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including, but not limited to, a breach of these Terms.
In no event shall Hummingbird Wellness, LLC, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the App.
These Terms shall be governed and construed in accordance with the laws of New York/USA, without regard to its conflict of law provisions.
